Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the Clear Choice Pool Fence website and your engagement of our installation services. By visiting our website, submitting a quote request, or proceeding with a service appointment, you agree to be bound by these Terms.
Clear Choice Pool Fence is operated by Michael Leifer, a licensed Arizona contractor (AZROC License No. 317289), providing removable mesh pool fencing installation services throughout Maricopa County, Arizona.
2. Estimates and Pricing
Our online aerial estimator provides pricing estimates based on approximate fence footage derived from satellite imagery. These estimates are informational and non-binding. Final pricing is confirmed on-site after our installer measures the actual perimeter to be fenced.
- Pricing is based on linear footage, fence height, number of gates, and color selected.
- A minimum job rate of $1,350 applies (includes one gate).
- Gate pricing: $475 per gate (4ft height) · $525 per gate (5ft height).
- Estimates are valid for 30 days from the date issued.
- Pricing may vary for non-standard pool shapes, difficult access areas, or unusual site conditions.
3. Payment Terms
We operate on a pay-on-completion basis. No deposit is required to schedule an appointment. Payment is due in full upon satisfactory completion of the installation, before our installer leaves your property.
Accepted payment methods include check, all major credit cards (subject to a 3% processing fee), Zelle, and Venmo. Returned checks or failed payments are subject to a $35 processing fee. Accounts more than 30 days past due may be referred to a collections agency.
4. Appointments and Cancellations
We ask that you notify us at least 24 hours in advance if you need to reschedule or cancel an appointment. Repeated same-day cancellations may result in a scheduling deposit being required for future bookings.
We reserve the right to reschedule appointments due to weather, equipment issues, or other circumstances outside our control. We will notify you as promptly as possible in these situations.
5. Installation and Site Conditions
The customer is responsible for ensuring reasonable access to the installation area on the scheduled appointment date. This includes:
- Clearing the pool deck perimeter of furniture, toys, and debris
- Ensuring pets are secured away from the work area
- Providing an adult (18+) on-site or accessible by phone during installation
Our installers will work with the homeowner to determine optimal fence placement. Final placement decisions rest with the customer. Changes requested after installation is underway may result in additional labor charges.
6. Warranty
We stand behind our work and materials:
- Lifetime warranty on all metallic hardware components (poles, fittings, latches) against defects in materials and workmanship under normal use.
- Mesh: Professional-grade UV-stabilized mesh is warranted against premature degradation under normal outdoor conditions in Arizona. Damage caused by sharp objects, pets, or intentional misuse is not covered.
- Gate mechanisms: Self-latching and self-closing mechanisms are covered for the life of the fence under normal residential use.
Warranty claims must be reported to Clear Choice Pool Fence by phone or email. We will repair or replace defective components at no charge. Warranty does not cover damage resulting from abuse, neglect, improper removal/reinstallation by non-Clear Choice personnel, or Acts of God.
7. Pool Code Compliance
Our fencing is designed and installed to meet Arizona Revised Statutes (A.R.S. § 36-1681) and Maricopa County pool barrier requirements. However, it is the homeowner's sole responsibility to:
- Verify local municipal or HOA requirements that may exceed state minimums
- Obtain any required permits (permit assistance available upon request)
- Ensure the fence is properly reinstalled after any removal
Clear Choice Pool Fence does not assume liability for code violations resulting from the homeowner's failure to maintain the fence in its installed configuration, or from modifications made by others.
8. Limitation of Liability
To the maximum extent permitted by Arizona law, Clear Choice Pool Fence's liability to you for any claim arising out of our services shall not exceed the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
Pool fencing is a safety barrier aid — it is not a substitute for adult supervision of children near water. We make no guarantee that a pool fence will prevent all unauthorized access to a pool.
9. Intellectual Property
All content on this website — including text, images, logos, pricing information, and the aerial estimator tool — is the property of Clear Choice Pool Fence and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use our content for commercial purposes without prior written consent.
10. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona.
11. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised effective date. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms.
